Please read these terms and conditions carefully before placing your order through the Unishops website. By placing an order, you agree to be bound by the terms and conditions listed below.

Article 1 - Definitions

In these terms and conditions the following terms shall have the following meanings:

  1. Withdrawal period: the period within which the Consumer can make use of his right of withdrawal;
  2. Consumer: the Unilever employee who works in the Netherlands, is directly employed by a Unilever entity, has a Unilever e-mail address and is not acting for purposes related to his trade, business, craft or profession;
  3. Day: calendar day;
  4. Right of Withdrawal: the option of the Consumer to waive the distance contract within the cooling-off period;
  5. Unilever: the legal entity Unilever Nederland B.V. which offers Products to the Consumer;
  6. Distance contract: an agreement concluded between Unilever and Consumer within the framework of the distance selling of Products, whereby until the conclusion of the agreement exclusive or joint use is made of one or more techniques for distance communication;
  7. Products: the Unilever products offered and sold through Unishops;
  8. Meansof distance communication: means that can be used for the conclusion of an agreement, without the consumer and Unilever having to come together in the same place at the same time.
  9. Unishops: the Dutch Unishops webshop where Consumers can purchase Products.

Article 3 - Applicability

  1. These General Terms and Conditions form part of any purchase agreement concluded between Unilever on the one hand and a Consumer on the other hand via Unishops.
  2. Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the Consumer by electronic means by means of a hyperlink.

Article 4 - The Offer

  1. The Products offered at Unishops are to be regarded as an offer without obligation.
  2. If an offer has a limited duration or is made subject to conditions, this will be expressly stated in the offer.
  3. The offer contains a complete and accurate description of the Products. The description is sufficiently detailed to allow a proper assessment of the offer by the Consumer. If Unilever makes use of pictures, they are for illustrative purposes only. The Products may differ slightly from these images.
    Unilever is not bound by obvious errors or mistakes in the offer.
  4. Unilever may from time to time change the range of Products and Unilever has no obligation to continue to offer certain Products.
  5. All offers contain such information that it is clear to the Consumer what rights and obligations are attached to accepting the offer.
  6. Unilever may set a reasonable minimum order size.
  7. The total amount that the Consumer can spend annually on Products through Unishops is limited to 2500 Euro.

Article 5 - The agreement

  1. The contract is concluded, subject to the provisions in paragraph 4, at the moment the Consumer accepts the offer and the conditions thereby set have been fulfilled.
  2. After the Consumer has accepted the offer electronically, Unilever will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by Unilever, the Consumer may dissolve the contract.
  3. Unilever will take appropriate technical and organisational measures to secure the electronic transmission of data and will provide a secure website. The Consumer may pay electronically and Unilever will implement and observe appropriate security measures for this purpose.
  4. Unilever may, within the limits of the law, investigate whether the Consumer can meet his payment obligations, as well as all those facts and factors that are important for a sound conclusion of the distance contract. If, on the basis of this investigation, Unilever has good grounds for not entering into the agreement, it is entitled to refuse an order or request while giving reasons, or to attach special conditions to the performance.
  5. Unilever will, at the latest before the Products are purchased, provide the following information to the Consumer in writing or in such a way that the Consumer can store it in an accessible manner:
  6. the visiting address of Unilever's branch office to which Consumer can address any complaints;
  7. the conditions under which and the way in which the Consumer may exercise the right of withdrawal, or a clear statement concerning the exclusion of the right of withdrawal;
  8. the information on guarantees and existing after-sales service;
  9. the price, including all taxes, of the Product; where applicable, the costs of delivery; and the method of payment, delivery or performance of the distance contract;
  10. how Consumer can revoke the agreement.

Article 6 - Right of withdrawal

  1. The Consumer may repudiate an agreement relating to the purchase of a Product during a cooling-off period of at least 14 days, without giving reasons. Unilever may ask the Consumer for the reason for withdrawal, but may not oblige the Consumer to state its reason(s).
  2. The cooling-off period mentioned in paragraph 1 commences on the day after the Consumer, or a third party designated by the Consumer in advance and who is not the carrier, has received the Product, or:
  3. if Consumer has ordered several Products in the same order: the day on which Consumer, or a third party designated by him, has received or collected the last Product. Unilever may, provided it has clearly informed the Consumer of this prior to the ordering process, refuse an order for multiple Products with a different delivery time.
  4. if the delivery of a Product consists of several shipments or parts: the day on which the Consumer, or a third party designated by him, has received or collected the last shipment or part;

Article 7 - Obligations of the Consumer during the cooling-off period

  1. During the reflection period, Consumer will handle the product and packaging with care. He/she shall only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. The starting point here is that Consumer may only handle and inspect the product as he/she would be allowed to do in a store.
  2. Consumer is only liable for depreciation of the product resulting from a way of handling the product that goes beyond what is allowed in paragraph 1.

Article 8 - Exercise of the right of withdrawal by Consumer and costs thereof

  1. If Consumer exercises his right of withdrawal, he/she will be able to do so via a return shipment. He/she shall report this within the cooling-off period via the PostNL website or app, where the Consumer must create a return consignment with the reply number stated on the packaging, after which he/she can return the Products, or he/she can register the consignment and hand it over at a PostNL parcel point by showing the reply number.
  2. As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the Consumer shall return the Product to the address indicated on the packaging and in the order confirmation. Consumer has in any case complied with the return period if he/she returns the Product before the cooling-off period has expired.
  3. Consumer shall return the Product with all delivered accessories, if reasonably possible in original condition and packaging, and in accordance with the reasonable and clear instructions provided by Unilever.
  4. The risk and the burden of proof of the correct and timely exercise of the right of withdrawal shall lie with the Consumer.
  5. Unilever will bear the direct costs of returning the Product.

Article 9 - Obligations of Unilever at Cancellation

  1. If Unilever makes it possible for the notice of withdrawal by the Consumer to be given electronically, an acknowledgement of receipt shall be sent to the Consumer without delay after the receipt of this notice.
  2. Unilever shall reimburse all payments made by the Consumer, including any delivery costs charged by Unilever for the returned Product(s), without undue delay but within 14 days from the day the Consumer gives notice of withdrawal. Unilever may wait with repayment until it has received the Product or until the Consumer can prove that he/she has returned the Product, whichever comes first.
  3. Unilever shall use for reimbursement the same means of payment that Consumer has used, unless Consumer agrees to a different method. The refund will be free of charge for the Consumer.

Article 10 - Exclusion of right of withdrawal

Unilever may exclude the following Products from the right of withdrawal, but only if Unilever has clearly stated this when making the offer, or at least in good time before concluding the contract:

  1. Products that spoil quickly or have a limited shelf life;
  2. Sealed Products which are not suitable for return due to reasons of health protection or hygiene and of which the seal has been broken after delivery;

Article 11 - The price

  1. The prices of Products listed on Unishops are valid at the time of purchase and may be changed from time to time. These changes do not affect orders already placed.
  2. The prices quoted in the offer of Products or services include VAT.

Article 12 - Performance of the Agreement

  1. Unilever guarantees that the Products comply with the contract, with the specifications stated in the offer, with the reasonable requirements of reliability and/or serviceability and with the existing statutory provisions and/or government regulations on the date on which the contract was concluded.

Article 13 - Delivery and implementation

  1. Unilever will take the greatest possible care when receiving and carrying out orders for Products.
  2. Unilever is entitled to deliver orders in parts.
  3. Consumers can choose to have the Products delivered to an address in the Netherlands
  4. The place of delivery is the address which the Consumer has made known to Unilever.
  5. Unilever is not responsible for any delay of an order as a result of incorrect or invalid payment details, nor for delivery to an incorrect address if incorrect address details are entered.
  6. Subject to what is stated in Article 4 of these General Conditions, Unilever will carry out accepted orders with due haste but at the latest within 30 days, unless a different delivery period has been agreed. If the delivery has been delayed, or if an order cannot be filled or can be filled only partially, the Consumer shall be informed of this within 30 days after he/she has placed the order. Consumer in that case has the right to terminate the contract without penalty.
  7. After dissolution in accordance with the preceding paragraph, Unilever will immediately refund the amount paid by the Consumer.
  8. The risk of damage and/or loss of the Products rests with Unilever up to the moment of delivery to the Consumer or to a representative designated by the Consumer and announced to Unilever in advance, unless expressly agreed otherwise.

Article 14 - Payment

  1. The Consumer must immediately pay the amount due for the Products during the checkout process by means of one of the payment methods offered.
  2. The Consumer has the duty to immediately report inaccuracies in payment details provided or stated to Unilever.
  3. If the Consumer does not fulfil its payment obligation(s) on time, after the late payment has been pointed out to it by Unilever and Unilever has granted the Consumer a period of 14 days to fulfil its payment obligations as yet, after the payment has not been made within this 14-day period, the Consumer shall owe the statutory interest on the amount still due and Unilever shall be entitled to charge the extrajudicial collection costs it incurs.

Article 15 - Complaints procedure

  1. If you have any questions, complaints or problems with Products or the operation of Unishops, we can be reached as follows:
    On the website is a contact form, where you can leave a message. When sharing your contact information, you will receive a reply as soon as possible.
  2. Complaints about the performance of the contract must be submitted to Unilever fully and clearly described within a reasonable time after the Consumer has discovered the defects, in the manner set out above.
  3. Complaints submitted to Unilever will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Unilever will respond within the 14-day period with a notice of receipt and an indication of when the Consumer can expect a more detailed answer.
  4. The Consumer must in any case give Unilever 4 weeks to resolve the complaint in mutual consultation. After this period a dispute arises that is subject to the dispute resolution procedure.

Article 16 - Disputes

Contracts between Unilever and Consumers to which these General Terms and Conditions relate are governed exclusively by Dutch law.
